Services - Wills & Power of Attorney
Did you know that how ever long you have been living together your partner will not automatically inherit anything on your death if you do not leave a Will? This can leave your partner and children in a very vulnerable position at a time they are least able to cope – they might even lose their home.
The population as a whole is getting older. When you are older or if you care for an older person you know that age brings its own special problems. Through hard work you may have acquired assets and you want to make sure you pass those to the ones you love – and the Taxman is probably not one of them. For a couple in a marriage or civil partnership, a properly drafted Will can save over £110000.00 in tax.
If you have paid all your taxes all your life, you want to protect your home from sale in the event of your needing residential care. We can help plan for this.
If you are the parents of a disabled child may you may want a Trust set up to enable your child to be cared for after your death. We can help.
We can draft an Lasting Power of Attorney to enable someone else to act on your behalf in the event of your being physically or mentally unable to do so.
We usually recommend that an Lasting Power of Attorney or a Trust is linked with the drafting of a Will. We all know that we will die but less than a third of the population makes a Will. You may be superstitious about making a Will but it is just common sense and is the only way you can try to protect and provide for your family after your death.
Wills are also used to give information that many find it difficult to talk about – if you would like to be buried or cremated, how you feel about organ transplant, where you want to be laid to rest – although most football clubs do not encourage the scattering of ashes on the pitch!
If you are facing an operation you may fear what you see as unnecessary medical intervention to keep you alive. We can make sure your wishes are known by the drafting of a ‘Living Will’.
We will ask you to meet us and we will go through all your assets with you. We will discuss how you want your estate dealt with. We will draft your Will and carry out any ancillary work necessary – for instance it may be advisable to transfer some assets now rather than wait. If necessary we will advise you to seek advice from an Independent Financial Advisor before making these decisions.
The cost of a Will, Trust or an Lasting Power of Attorney will depend on the complexity but we will advise you of this as early as we can and let you know if things become more complex as it progresses before any extra work is undertaken so you are in control of costs.
