When a member of your family dies there are all sorts of matters needing attention – at a time when you feel least able to deal with it all. The funeral is the most immediate concern but life does go on and bills have to be paid and assets have to be dealt with.
If a Will has been left this guides you through the wishes of your deceased relative although the Will has to be ‘proved’. This process is known as ‘probate’. It is possible for a Will to be changed after death by a Deed of Family Arrangement, if the family agrees. This can reduce the Inheritance Tax bill.
If there is no Will, this is known as being ‘Intestate’ and the law lays down a procedure for the division of assets. This can lead to arbitrary and unfair results, which is why we encourage all clients to make a Will.
All the assets need to be recovered and the debts paid. The estate then needs to be divided up in accordance with the Will or Rules of Intestacy. Missing relatives may need to be traced. The Title of a property may need to be changed and we can deal with this too. All this known as the ‘administration of the estate’.
It is one of the most difficult times for any family and long suppressed animosities and family feuds often come to the surface at this time.
