If you have had an accident that is not your fault you may well be entitled to compensation. This is in two parts, general damages which compensate you for your injury (as if money can do that!) and a special damage which covers financial losses arising from the accident.
A claim usually has to be made within three years of the accident or reaching majority if you are a minor at the time of the accident. If you discover an injury at a later date and this can happen with industrial diseases particularly, the same time limits apply but run from the time you knew of the injury or should have known of it.
We talk to you about the accident and who you believe is responsible. We then notify that person or organisation of the claim and deal with the matter on your behalf whether it settles or if proceedings have to be issued.
You will have to go through a medical examination and your claim may not settle until you are fully recovered. If that is likely to be a long time an interim payment to you may be possible if the other side accept they are responsible for the accident.
You will have heard of ‘No Win – No Fee’ agreements and we will discuss this and other sources of funding with you. Many people have insurance cover for legal expenses without even realising it.
If you are defending a personal injury claim against you, you are probably insured and your insurers are dealing with it on your behalf but this is not always the case and again we can help.
