You may have a dispute with your neighbour about the position of the boundary, or an ex-employee may be taking your trade secrets to the competition.  If you receive a letter from a solicitor acting for someone else you are likely to be shocked and upset and unsure of your rights.

Court proceedings are the last resort not the first and there are many ways disputes can be dealt with short of the Courtroom.  We actively encourage these to be explored and can put you in touch with mediators or arbitrator.  If the case does not settle we are equally happy to fight it through the Courts for you.

Legal costs are a real issue in such matters and the Court will expect proceedings to be dealt with in a ‘proportionate’ way.  This means that costs should be proportionate to the amount in dispute.  If you are successful you will probably recover most of your costs, but this should never be taken for granted.  In particular, we suggest carrying out financial checks before proceedings are started as there is no point putting good money after bad.  It may be ‘A matter of principle’ but principles are expensive!

We will always keep you informed of costs so far as we can both yours and the risk of you having to pay your opponents costs.  Most cases do settle, however.
